1. INTRODUCTION
1.1 Please read these Terms of Service carefully. By using niinii services, you agree that you have read and understand the terms in these Terms of
Service that apply to you. These Terms of Service and the niinii Policy (as set forth) constitute a legal agreement between you and niinii. This Agreement
is binding on your use of the services (as specified) provided by niinii. If you do not agree to the Terms of Service, please do not use or continue to use
this Application or Service.
1.2 niinii may amend the terms of this Agreement at any time. The amendment will take effect as soon as it is posted on https://www.niinii.com or on the Application.
It is your responsibility to review these Terms of Service periodically. Your continued use of the service after any amendment by you, whether reviewed by you or
not is deemed to be your consent to be bound by such amendment.
1.3 If you use the service in a Country other than which you registered the Application (“the Alternative Country”), you should periodically review the Terms of Service
available in that Alternative Country which can be found at https://www.niinii.com as they may differ in which Country you registered the Application. By using the Service
in such Alternative Country, you agree to be bound by the stated Terms of Service.
1.4 niinii is a technology company that provides a platform for users to obtain maid services provided by us or partners. This task is simply to connect users and partners
through the platform. niinii is not liable for any action or misconduct by the partner. The partner shall bear all liabilities involving the services offered. The partner
is not and shall not identify himself as an agent, employee or staff of niinii and any settlement offer by the service provider shall not be deemed to be provided by niinii.
2. DEFINITIONS
2.1 “Application” means the relevant telephone application provided by niinii(or its licensee) for download by users and partners;
2.2 “Consumer” or “User” means any end user who accesses or uses the Platform to seek or obtain a Solution;
2.3 “Consumer Charges” or “Consumer Charges” means charges imposed on consumers for Solutions obtained through the use of the services, including any tolls, taxes and any
fees or charges imposed due to the use of the Services or Solutions;
2.4 “niinii” / “we” means Agensi Pekerjaan MLMS Sdn Bhd;
2.5 'niinii Policy' means as follows:
2.5.1 Privacy Policy
2.5.2 Service Provider / niinii Code of Conduct or niinii Consumer / User Code of Conduct that may apply; and
2.5.3 Any form of policies, notices, guidelines, frequently asked questions (FAQs) or any agreements prepared or entered by you from time to time
2.6 “Partner” means any independent third party (not niinii) who provides the relevant Solution to the Consumer/Consumer through the Service, including the niinii and any
relevant service provider.
2.7 “Personal Data” means any information that can be used to authenticate you or from which you can be authenticated. This includes but is not limited to name, nationality,
telephone number, bank and credit card information, personal interests, email address, your image/photograph, government -issued identification number, biometric data, race,
date of birth, marital status, religion, health information, vehicle and insurance information.
2.8 “Platform” means the Application, Software and any platform, portal or website owned by niinii, operating or available to Consumers/Users and/or partners for the purpose of
or in connection with the Services and/or Solutions.
2.9 “Privacy Policy” means our privacy policy which can be accessed at https://www.niinii.com as amended from time to time.
2.10 “Service” means the relationship between a Consumer/User to a Partner or another Consumer/User through an Application, Platform and/or Software (Software).
2.11 “Software” means any software related to the Application supplied for installation by niinii and available for download.
2.12 “Solution” means the package of services provided, additional packages offered including training, medical reports, logistics, insurance and/or any products and services
provided and/or offered to Consumers/Consumers through the platform.
2.13 “You” means the Partner and/or Consumer/Consumer as appropriate.
3. REPRESENTATIONS, WARRANTIES AND UNDERTAKING
4. COMPATIBILITY
Different models or versions of routers, browsers, and devices may cause firmware or settings to be incompatible with the Application, Platform and Software. While we continue
to develop Applications, Platforms and Software (Software) to best support all models of devices and browsers in the market commonly used for Applications, Platforms and
Software (Software) in access, we do not guarantee the compatibility of Applications, Platforms and Software ( Software) with a phone device or other specialized hardware.
5. GRANTING OF LICENSES AND RESTRICTIONS
5.1 Niinii and its licensee, if applicable, grant you a non-exclusive, non-transferable, and revocable limited license to use and access the Application and/or software
(Software) to use the Services subject to the terms and conditions of this Agreement. All rights not expressed to you are reserved to niinii and her licensee.
5.2 You are not allowed to:
5.2.1 Post, distribute or remove in any way any copyrighted material, trademarks or other proprietary information without the prior permission
of the owner to such title; or
5.2.2 Remove any copyright, trademark or other proprietary rights notices contained in the Application or Platform.
6. PAYMENT
6.1 niinii charges a fee for your use of the Services. Service Fee upon payment will not be refunded. This non-refundable policy shall apply at all times even if you
decide to cancel your access to the Application/ Platform, our decision to cancel or withhold your access to the Application/ Platform, interruption of the Service
whether planned, intentionally or unintentionally or due to any whatever the reason.
6.2 You hereby acknowledge and confirm that niinii authorized to administer and act as a collection agent for you to pay the entire amount of consumer/consumer
charges imposed on you.
6.3 niinii has the absolute power to suspend the processing of any transaction if it is believed that the transaction involves fraud, is illegal or involves any criminal
activity or you and/or the user are in breach of any of this Agreement. . In such circumstances, you may not make niinii liable for any delay, detention, disposal
or cancellation of any payment to you.
6.4 niinii may at its sole discretion offer promotions with different features and rates of the Solution to any user where the promotional offer must be complied with
by you. niinii may change the service fee charged at any time at its own discretion.
6.5 Users are required to make full payment for all services offered in the Application using the method selected at the time of booking, either in cash or one of the
automatic payment methods available to you in the Application. Any payments made will not be refunded and cannot be canceled.
6.6 Payment can be made automatically using a debit or credit card or through any of the methods available in the Application. The terms for non-cash payments made
by you through the Application will be governed by the niinii Terms of Service which can be accessed through the https website: https://www.niinii.com
7. COMPLAINTS
Any complaints between Partners and Users shall be resolved directly with each other.
8. OWNERSHIP OF INTELLECTUAL PROPERTY
niinii and its licensors, if applicable, shall own all rights, and interests including all rights over the relevant intellectual property of the Software and/or
Applications as well as any other additions to services, suggestions, ideas, additions to requests, feedback , recommendations or other information provided by
you or others in connection with the service. The Terms of Service do not constitute a sales agreement and do not transfer to you any ownership rights in or
in connection with the services, Software, and/or Applications or any intellectual property rights held by niinii and/or its licensors. The niinii name, logo,
services, software and/or Application associated with the software and/or Application are trademarks of niinii. Third parties have no right or license to use it.
For the avoidance of confusion, the terms of the Software and Application shall include the relevant components, processes and overall design.
9. CONFIDENTIALITY
You must personally use and maintain the confidentiality of all niinii related information and data, services, products, business dealings, marketing and
other promotional or operational plans and niinii related companies disclosed to you by or on behalf of niinii (either orally, in writing and either before
during or after this agreement) whether obtained directly or indirectly by you from niinii or any company affiliated with or formed in the agreement.
Further, you must ensure that you only use such information privately to use the Services and must without prior permission from niinii submit such information
to any third party or use it for other purposes.
10. CONFIDENTIAL DATA POLICY AND PERSONAL DATA PROTECTION
niinii collects and processes your data in accordance with the agency’s Privacy Policy. The Privacy Policy applies to all niinii services and hereby the terms
created are part of this agreement.
11. RESPONSIBILITY
By agreeing to the Terms of Service while using this service, you agree that you shall indemnify niinii, its licensees or any of its affiliates, officers,
directors, members, employees, attorneys and agents from or against any claims for damages, liabilities, costs and expenses (including attorney's fees
and/or regulatory action costs) arising from or in connection with:
a) Use of the services, platforms, software and /or Applications by you in dealing with partners or users, third party merchants,
providers, partners, advertisers and /or contributors;
b) Violation or breach of any Terms of Service, the terms and conditions of any third party, or any laws or regulations whether referred to herein or not
c) Infringement of any rights of third parties, including partners or users managed through this service; or
d) Use or misuse of services, platforms, software and/or applications; and
e) Where appropriate, the ownership, use or operation of any property, including the provision of solutions to users through services.
12. RELEASE OF WARRANTY
12.1 This application, its content or any related services are provided to you on an “as is where is basis”). niinii makes no representations or warranties of
any kind, express or implied with respect to the software, Applications, Platforms, Services, Terms of Service, related content, or services. While we strive
to ensure that the Application is up to date, we make no representations, warranties, or warranties whether express or implied that the information is accurate,
complete and up to date. We shall not be liable for any continuing losses either directly or indirectly as a result of alterations or amendments to the software,
Applications, Platforms, services or Terms of Service.
12.2 niinii makes no representations or warranties in any form whether express or implied with reference to the Solutions provided by the partner or any Solutions
obtained through the use of the Services. You agree that you shall bear the risks arising from the use of the Services and any Solutions provided by the Partner
and shall not claim from niinii and respect of the same.
13. INTERNET SUSPENSION
Services, application platforms and/or software may be subject to limitations, delays and any problems arising from the internet and electronic communications
including devices used by you or your partner are faulty, disconnected, out of area, closed or malfunctioning. niinii not responsible for any delays, delivery failures,
damages or losses resulting from such problems.
14. LIMITATION OF LIABILITY
14.1 Other than as stated subject to the full provisions of the law, any claim against niinii shall be limited only to the aggregate amount of all amounts paid or
remaining by you while using the services at any material time. niinii and its licensors shall not be liable for any loss, damage or injury that occurs to you or
to any person to whom you order services or solutions including but not limited to:
14.1.1 Loss, damage or injury caused by or in connection with the service, platform, application and/or software
14.1.2 Use or failure to use services, platforms, applications and/or software
14.1.3 Any backup made by you as to the adequacy, accuracy or existence of any advertisement; or
14.1.4 As a result of any relationship or transaction between you, any user, partner, merchant, advertiser or contributor whose advertisement
is displayed on a website or referral by a service, application and/or software.
Disclaimer niiniiFAST PACKAGE
- The maximum replacement time period is 365 days.
- Refund will be made after the replacement period ends.
- Refunds will be refunded except agency fees.
- Agency fees 30% .
SOP Keselamatan
niiniiFAST (Part-Time)
1. Majikan / wakil perlu membuat pemeriksaan badan (pemeriksa wajib mengikut jantina pekerja)
dan sediakan satu tempat khas yang selamat untuk niinii (pekerja) meletakkan barang / beg.
2. Majikan mesti membenarkan gambar dan rakaman dilakukan oleh niinii (pekerja) sepanjang niinii (pekerja) berada di
rumah majikan (sebagai keselamatan).
3. Majikan wajib berikan wifi / hotspot kepada niinii (pekerja) untuk kegunaan video keselamatan.
4. Majikan wajib membuat rakaman review ringkas (bersama niinii (pekerja)) di setiap ruangan kerja
disertakan dengan majikan perlu menyebut dengan jelas arahan kepada niinii (pekerja) di dalam
rakaman berkenaan sebelum niinii (pekerja) jalankan tugas.
5. niinii (pekerja) wajib membuat rakaman review ringkas di setiap ruangan kerja disertakan dengan
niinii (pekerja) menyebut semula dengan jelas arahan yang diberikan oleh majikan di dalam rakaman
berkenaan semasa niinii (pekerja) sedang jalankan tugas.
6. Majikan wajib membuat rakaman ringkas mengenai feedback terhadap niinii (pekerja) pada agensi
selepas niinii (pekerja) menyiapkan tugasan.
